RACE STINT TERMS OF SERVICE
These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your", or "User") and Code State Ltd, a company registered in England and Wales with company number 12856318, registered office 128 City Road, London, EC1V 2NX ("Code State", "we", "us", or "our"), governing your use of the Race Stint service.
By creating an account, accessing or using the Service, or clicking "I agree", you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Notice, and (if you install the Race Stint Windows Agent) our End User Licence Agreement. If you do not agree, you must not use the Service.
If you are using the Service on behalf of a team or organisation, you confirm that you have the authority to bind that team or organisation to these Terms.
1. ABOUT RACE STINT
1.1 Race Stint is a telemetry-driven endurance race strategy platform for sim racing, currently supporting Le Mans Ultimate and iRacing, comprising:
1.1.1 the racestint.app website;
1.1.2 the Race Stint web and mobile dashboard;
1.1.3 the Race Stint Windows Agent (the "Agent"), which is licensed under our separate End User Licence Agreement; and
1.1.4 any related APIs, content, and features we make available
(collectively, the "Service"). References in these Terms to a "Supported Sim" mean Le Mans Ultimate, iRacing, or any other sim racing platform Race Stint adds support for in the future.
1.2 Race Stint is an independent third-party application. It is not developed, published, endorsed, sponsored by, or affiliated with Studio 397 BV, Motorsport Games Inc., iRacing.com Motorsport Simulations, LLC, the Automobile Club de l'Ouest (ACO), the Fédération Internationale de l'Automobile (FIA), NASCAR, IndyCar, IMSA, or any other rights holder of any Supported Sim or its licensed content. Trade marks referenced within the Service belong to their respective owners and are used solely to identify the sim and content with which Race Stint interoperates.
2. ELIGIBILITY AND ACCOUNTS
2.1 Eligibility
2.1.1 You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
2.1.2 You must not be barred from using the Service under the laws of the United Kingdom or any other applicable jurisdiction, and you must not be on any sanctions list or in a sanctioned country.
2.1.3 You must not be a competitor of Code State, and you must not access the Service in order to build or improve a competing product.
2.2 Account creation
2.2.1 You must provide accurate, current, and complete information when registering, and keep that information up to date.
2.2.2 You are responsible for keeping your password and authentication credentials secure. You must enable two-factor authentication where it is offered.
2.2.3 You are responsible for all activity that occurs under your account, whether or not you authorised it. Notify us immediately at [email protected] if you suspect unauthorised access.
2.2.4 One account per person. You must not share your account credentials, sell or transfer your account, or create multiple accounts to circumvent limits, suspensions, or bans.
3. SUBSCRIPTION TIERS, PRICING, AND PAYMENT
3.1 Tiers
3.1.1 The Service is offered on the following tiers, with features and limits as published on racestint.app:
- Silver — paid tier with core strategy features
- Gold — paid tier with full features including post-race AI debriefs and live race chat
- Founding Members / Beta — limited-cohort early access offered to selected users on terms communicated separately at the time of invitation
3.1.2 We may change the features, limits, and pricing of any tier from time to time. Where changes are material and adverse to you, we will give you at least 30 days' prior notice and you may cancel before the changes take effect.
3.2 Payment
3.2.1 Paid subscriptions are billed monthly in advance. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the next renewal date.
3.2.2 Payments are processed by Stripe. By providing payment details, you authorise us (via Stripe) to charge your chosen payment method for each billing period. You are responsible for ensuring your payment details remain valid.
3.2.3 All prices are stated in pounds sterling (GBP) and are inclusive of UK VAT where applicable. Where you are based outside the UK, you are responsible for any local taxes.
3.2.4 If a payment fails, we may suspend or downgrade your access until payment is received. We may attempt to collect a failed payment again before suspending.
3.3 Cancellation
3.3.1 You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access until that date.
3.3.2 We do not pro-rate refunds for partial months.
3.4 Cooling-off period — important consumer notice
3.4.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, UK consumers normally have a 14-day right to cancel a contract for digital services and receive a refund.
3.4.2 The Service is supplied as a digital service that begins immediately on signup. By creating a paid subscription and ticking the relevant consent box at checkout, you expressly request that the Service begins immediately and acknowledge that you will lose your right to cancel under those Regulations once the Service has started. No refund will be given for the period during which the Service has been provided.
3.4.3 This clause does not affect your statutory rights as a consumer where the Service is faulty, mis-described, or not as agreed.
3.5 Promotions and free access
3.5.1 Where we offer a tier free of charge for a limited period (for example, the Founding Members beta), the terms of that offer will be communicated at the time. At the end of the free period, your account will either revert to a free tier (if available), be downgraded, or require payment to continue — we will tell you in advance.
4. YOUR DATA AND OWNERSHIP
4.1 You own your telemetry
4.1.1 As between you and Code State, you retain ownership of all telemetry data, lap data, stint data, team data, and other content you upload to the Service ("Your Data"). We do not claim ownership of Your Data.
4.2 Licence you grant us
4.2.1 To run the Service, generate strategy, build community baselines, support you, and otherwise operate Race Stint, you grant Code State a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, copy, transmit, process, analyse, aggregate, anonymise, create derivative works from, and otherwise use Your Data for the following purposes:
4.2.1.1 providing the Service to you and to your team members where you have shared data with them;
4.2.1.2 generating race strategy, fuel models, tyre crossover predictions, post-race debriefs, and other features;
4.2.1.3 building anonymised, aggregated community baselines per car / track / compound, which we may use, retain, and commercialise as part of the Service even after your account is deleted, provided that such baselines cannot be used to identify you;
4.2.1.4 operating, monitoring, securing, debugging, and improving the Service;
4.2.1.5 internal research and analysis; and
4.2.1.6 complying with our legal obligations.
4.2.2 This licence ends, in respect of identifiable Your Data, when you delete your account, save that:
4.2.2.1 we may retain Your Data for the periods set out in our Privacy Notice (for example, in backups for up to 35 days, billing records for 7 years where required by law);
4.2.2.2 anonymised and aggregated derivatives that cannot identify you (including community baselines) survive account deletion, in line with section 4.2.1.3.
4.3 Anonymised and aggregated data
4.3.1 We may create anonymised and aggregated data from Your Data and from the data of all users. Once truly anonymised, that data is no longer personal data and is owned by Code State. We may use it for any lawful purpose.
4.4 Feedback
4.4.1 If you give us feedback, suggestions, ideas, or bug reports, you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use them without restriction or attribution.
4.5 Privacy
4.5.1 Our handling of personal data is described in our Privacy Notice at racestint.app/privacy, which forms part of these Terms.
5. ACCEPTABLE USE
5.1 You agree that you will not:
5.1.1 use the Service in breach of any law, regulation, or any third party's rights, including the end user licence agreement, terms of use, or sporting code of any Supported Sim with which the Service interacts (including without limitation the Le Mans Ultimate EULA, the iRacing Terms of Use and EULA, and the iRacing Official Sporting Code);
5.1.2 use the Service in any officially sanctioned competition, ranked online race, league, or esports event whose rules prohibit external strategy or telemetry tools;
5.1.3 upload data that is not yours, that you do not have the right to share, or that infringes any intellectual property right;
5.1.4 attempt to gain unauthorised access to the Service, other users' accounts, or any system or network connected to the Service;
5.1.5 reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service, except to the extent expressly permitted by law;
5.1.6 use the Service to develop, train, or improve any product or service that competes with Race Stint;
5.1.7 scrape, crawl, harvest, or otherwise extract data from the Service in bulk or by automated means, except via APIs we expressly make available to you;
5.1.8 send spam, malicious code, or any content that is unlawful, defamatory, harassing, abusive, hateful, threatening, obscene, or that promotes self-harm or violence;
5.1.9 impersonate any person or entity, or misrepresent your affiliation with anyone;
5.1.10 interfere with or disrupt the Service, the servers or networks that host it, or other users' enjoyment of it; or
5.1.11 circumvent, disable, or attempt to bypass any usage limits, technical protection measures, rate limits, or anti-cheat systems.
5.2 We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached this section 5.
6. TEAMS AND SHARED DATA
6.1 Race Stint allows you to form a team and share telemetry, strategy, and event data with other Users you invite.
6.2 By inviting another User to your team, you confirm you have the right to share Your Data with them, and you accept that they will be able to view, use, and (subject to their role) modify the shared data.
6.3 The team owner is responsible for managing membership and may remove members at any time.
6.4 We are not responsible for disputes between team members about access, use, or attribution of shared data.
7. THIRD-PARTY SERVICES AND GAMES
7.1 Le Mans Ultimate
7.1.1 Race Stint is designed to work with Le Mans Ultimate, which is developed by Studio 397 BV and published by Motorsport Games Inc. Your use of Le Mans Ultimate is governed by your separate agreement with Studio 397 BV.
7.1.2 The Agent reads telemetry from a memory-mapped file populated by the open-source community plugin rFactor2SharedMemoryMapPlugin64, which is not distributed by Code State and is licensed separately under its own open-source licence. You are responsible for installing and maintaining that plugin.
7.2 iRacing
7.2.1 Race Stint is designed to work with iRacing, which is developed and operated by iRacing.com Motorsport Simulations, LLC. Your use of iRacing is governed by your separate iRacing Terms of Use and EULA, iRacing Privacy Policy, and iRacing Official Sporting Code with iRacing.
7.2.2 The Agent reads telemetry exclusively from the official iRacing SDK (IRSDK) memory-mapped file published by iRacing for use by third-party applications. The Agent does not access iRacing's servers, the iRacing /data REST API, or any other proprietary iRacing interface, and does not modify the iRacing software in any way.
7.2.3 You are solely responsible for complying with the iRacing Sporting Code and any anti-cheat or fair-play rules applicable to events, series, or sessions in which you participate. Race Stint is a passive telemetry reader and is not a "cheat", "bot", "mod", "hack" or any other prohibited program within the meaning of any Supported Sim's EULA or anti-cheat policy. However, iRacing has sole discretion to determine which third-party applications it permits, and you accept the risk of any consequences arising from your use of the Service alongside iRacing.
7.3 Sanctioned events and leagues
7.3.1 Some leagues, series, championships, and sanctioned events may prohibit external strategy, telemetry, or coaching tools. Where they do, you must not use the Service during those events. You are solely responsible for confirming the rules of any event in which you participate.
7.4 Other third-party processors
7.4.1 The Service relies on third-party processors (Laravel Cloud, Resend, Cloudflare, Anthropic, Stripe). They are listed in our Privacy Notice. We are not responsible for the acts or omissions of third parties beyond what is required by data protection law and our contracts with those processors.
8. INTELLECTUAL PROPERTY
8.1 Other than Your Data, all intellectual property in the Service — including the Race Stint name and logo, the website, the dashboard, the Agent, the underlying software, designs, content, branding, and the carbon / racing-green / velocity-red colour palette — is owned by or licensed to Code State.
8.2 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal use during the term of your subscription.
8.3 You receive no rights other than those expressly set out in these Terms.
9. BETA AND EVOLVING SERVICE
9.1 The Service is currently in beta. Features may be incomplete, change, or be removed. Strategy outputs, fuel calculations, tyre crossover predictions, and other recommendations may be inaccurate.
9.2 Race strategy is a prediction, not a guarantee. You are solely responsible for all race decisions you make. Do not rely on the Service as the sole basis for any race decision, and do not use it where its inaccuracy could cause loss or harm.
9.3 We may add, modify, suspend, or remove features at any time. We will give reasonable notice of material changes affecting paid tiers.
10. AVAILABILITY
10.1 We aim to keep the Service available, but we do not guarantee uninterrupted, error-free, or fault-tolerant operation. The Service may be temporarily unavailable for maintenance, updates, or factors outside our reasonable control.
10.2 We do not currently offer a service-level agreement (SLA). If we introduce one, it will be published separately.
11. DISCLAIMERS
11.1 To the fullest extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, accuracy, completeness, or non-infringement.
11.2 Without limiting section 11.1, we do not warrant that:
11.2.1 the Service will meet your requirements;
11.2.2 strategy outputs will be accurate, complete, or improve your race results;
11.2.3 the Service will be uninterrupted, timely, or error-free;
11.2.4 telemetry will always be captured correctly given the limitations of any Supported Sim's telemetry interface (including without limitation the Le Mans Ultimate shared memory plugin and the iRacing SDK) and any third-party library used to read it; or
11.2.5 the Service is free from defects.
11.3 Nothing in these Terms affects your statutory rights as a consumer that cannot be excluded or limited by law.
12. LIMITATION OF LIABILITY
12.1 Nothing in these Terms excludes or limits our liability for:
12.1.1 death or personal injury caused by our negligence;
12.1.2 fraud or fraudulent misrepresentation; or
12.1.3 any other liability that cannot lawfully be excluded.
12.2 Subject to section 12.1, and to the fullest extent permitted by law:
12.2.1 we will not be liable for any indirect, special, incidental, consequential, exemplary or punitive damages, or for loss of profit, loss of revenue, loss of business, loss of opportunity, loss of goodwill, loss of data, loss of race results, loss of championship points, or wasted entry fees, in each case howsoever arising; and
12.2.2 our total aggregate liability to you arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the greater of:
12.2.2.1 the total amount paid by you to us under your subscription in the twelve (12) months preceding the event giving rise to the claim; and
12.2.2.2 one hundred pounds sterling (£100).
12.3 The Service is for personal, non-commercial use. We will have no liability for any commercial losses you may suffer.
13. INDEMNITY
13.1 You agree to indemnify Code State against all claims, liabilities, damages, losses, and reasonable costs (including legal fees) arising from:
13.1.1 your breach of these Terms, the EULA, or the Privacy Notice;
13.1.2 your breach of any third-party agreement, including the end user licence agreement, terms of use, or sporting code of any Supported Sim (including without limitation the Le Mans Ultimate EULA and the iRacing Terms of Use and EULA); or
13.1.3 your breach of any law, or any third party's rights, in connection with your use of the Service.
13.2 This section 13 does not apply to consumers acting outside the course of a business, except where required by law.
14. TERMINATION
14.1 You may terminate these Terms at any time by closing your account from your account settings.
14.2 We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you have:
14.2.1 breached these Terms in a material or persistent way;
14.2.2 failed to pay any sums due;
14.2.3 used the Service in a way that exposes Code State or other users to legal, security, or reputational risk; or
14.2.4 not used the Service for an extended period (we will give reasonable notice for inactivity terminations).
14.3 We may terminate the Service in its entirety on at least 60 days' written notice. If we do, we will offer pro-rata refunds of pre-paid sums for the unused portion of any subscription.
14.4 On termination:
14.4.1 your right to access the Service ends immediately;
14.4.2 we will delete or anonymise Your Data in accordance with the retention windows in our Privacy Notice; and
14.4.3 the provisions which by their nature should survive (including sections 4, 8, 11, 12, 13, and 17) will survive.
15. CHANGES TO THESE TERMS
15.1 We may update these Terms from time to time. The "Last updated" date will reflect the latest change.
15.2 Where changes are material and adverse to you, we will give you at least 30 days' notice by email or through the Service before they take effect, and you may close your account before the changes apply.
15.3 Continued use of the Service after the effective date of updated Terms constitutes acceptance.

16.2 Notices to you will be sent to the email address on your account, or posted within the Service.
17. GENERAL
17.1 Entire agreement. These Terms, together with the Privacy Notice and (where you have installed the Agent) the EULA, are the entire agreement between you and us. They supersede any prior agreements or representations.
17.2 Assignment. You may not assign or transfer these Terms. Code State may assign or transfer these Terms freely, including to a successor business.
17.3 Severability. If any provision is found unenforceable, the rest remains in force, and the unenforceable provision will be modified only to the extent needed to make it enforceable.
17.4 No waiver. A failure or delay in enforcing any right is not a waiver of that right.
17.5 No third-party rights. A person who is not a party has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term, except where these Terms expressly say otherwise.
17.6 Force majeure. We will not be liable for any failure to perform our obligations due to causes beyond our reasonable control (including infrastructure outages affecting Laravel Cloud, AWS, Cloudflare, or Anthropic).
17.7 Relationship. Nothing in these Terms creates any partnership, agency, joint venture, or employment relationship between you and Code State.
17.8 Governing law and jurisdiction. These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that if you are a consumer resident in another part of the United Kingdom you may bring proceedings in your local courts.
17.9 Consumer rights. Nothing in these Terms affects your statutory rights as a consumer that cannot be excluded or limited by law.
